However, allegations emerged that officials from the Air Force Headquarters Force Support System Project Group provided unfair advantages to a specific company during this project.<\/p>\n<p>The core issue of this case involves the responsible officials arbitrarily modifying bidding procedures to enable a specific company&#8217;s participation and condoning violations of Request for Proposal (RFP) standards during the performance evaluation phase.<\/p>\n<p>Particularly noteworthy is that despite five out of six participating companies raising objections unanimously at the performance evaluation site, the officials dismissed these concerns and proceeded with the evaluation. This posed serious problems for the fairness of public procurement. Atlas Legal successfully identified these irregularities and held the responsible parties accountable through legal action.<\/p>\n<h2 id=\"section2\">2. Bid Announcement Manipulation Allegations for Specific Company Benefits<\/h2>\n<h3>Intentional Manipulation of Bid Announcement Schedule<\/h3>\n<p>The initial announcement was published on August 23, Year XX. Subsequently, the responsible officials took a series of highly suspicious actions.<\/p>\n<p>On October 5, Year XX, they announced a bid postponement citing vague &#8220;administrative errors.&#8221; The following day, October 6, they announced plans to cancel the existing announcement and issue a new one. Then, on October 11 at 7:43 PM, they officially canceled the existing announcement and posted a new announcement just 30 minutes later at 8:13 PM.<\/p>\n<h3>Company Qualification Requirements and Specific Company&#8217;s Situation<\/h3>\n<p>The mandatory qualification requirements specified in the RFP were as follows:<\/p>\n<ul>\n<li>Korean Standard Industrial Classification 31312 (Unmanned Aircraft and Unmanned Flying Device Manufacturing) registration<\/li>\n<li>Korean Standard Industrial Classification 301 or 302 (Automotive Engine Manufacturing or Automotive Body Manufacturing) registration<\/li>\n<li>Software Industry Promotion Act-related business registration<\/li>\n<\/ul>\n<p>Investigation revealed that the specific company in question did not meet the Korean Standard Industrial Classification 301 or 302 requirements at the time of the initial announcement. Strong allegations emerged that the responsible officials artificially manipulated the bidding schedule to provide the company with time to meet the requirements.<\/p>\n<h2 id=\"section3\">3. Specification Violations Discovered During Performance Evaluation<\/h2>\n<h3>Frequency Usage Standard Violations<\/h3>\n<p>According to the domestic frequency allocation table and RFP section 3.3.2.3.4, the frequency band available for unmanned aircraft is strictly limited to 5.65-5.85GHz.<\/p>\n<p>However, during the performance evaluation conducted on October 25, Year XX, in Gyuam-myeon, Buyeo-gun, Chungcheongnam-do, the specific company was found to use the following unauthorized frequencies:<\/p>\n<ul>\n<li>5,500MHz (frequency outside regulatory range)<\/li>\n<li>5,580MHz (frequency outside regulatory range)<\/li>\n<li>5,620MHz (frequency outside regulatory range)<\/li>\n<\/ul>\n<p>These frequencies fall within the 5,470-5,650MHz range, which prohibits aviation mobile use and is only permitted for maritime radio navigation purposes. Using these frequencies for unmanned aircraft constitutes a clear violation of radio wave laws.<\/p>\n<h3>Inappropriate Response to On-Site Objections<\/h3>\n<p>All five companies participating in the performance evaluation, excluding the problematic company, strongly protested the use of frequencies that violated RFP standards. Some company representatives even captured smartphone footage of the unauthorized frequency usage as evidence.<\/p>\n<p>However, the responsible officials refused to acknowledge these legitimate objections and continued with the performance evaluation. This represents a failure to fulfill the basic duty of officials to ensure fair evaluation.<\/p>\n<h2 id=\"section4\">4.
